In Massachusetts, if you are injured on the job, your employer must pay you workers’ compensation benefits.  Once you notify your employer, you should receive benefits within 21 days.  If you are totally disabled, you are entitled to receive 60 percent of your average weekly wage for up to 3 years.  If you are partially disabled, you are entitled to receive 60 percent of the weekly money you are losing.  You may collect partial disability benefits for 4 years.  If you are permanently and totally disabled, you are entitled to collect 60 percent of your lost wages for the rest of your life. 

 

If your employer does not begin payments within 30 days of your date of injury, or if you are denied benefits by your employer’s workers’ compensation carrier, you must file a claim with the Industrial Accident Board.  If you hire an attorney, and you receive benefits pursuant to an award of the Industrial Accident Board, your attorney’s fees will be paid by the workers’ compensation insurance company.  Often times, after you are receiving workers’ compensation benefits, the workers’ compensation carrier will offer you a lump sum of money rather than pay you weekly benefits.  An attorney can help you negotiate a settlement with the workers’ compensation carrier.  For some of your rights go to: Workers Compensation Advisory Council
